By accepting, You acknowledge that no Services offered by Us will include nor are they deemed to be defined as investment advice.

We are not realtors, mortgage brokers nor financial advisors. The Services are all based on fundamentals and the personal experience of FFS and Us and/or Our clients who have consented to the use of their experiences for the purpose of Our Services.

"System": means any online communications infrastructure that Foundations For Success  makes available through the Website either now or in the future. This includes, but is not limited to, web-based email, message boards, live chat facilities and email links;

If you are using the Services on behalf of an organization, You are agreeing to these Terms for that organization and confirming now to FFS that you have the authority to bind said organization to Our Terms of Service (in which event, “You” and “Your” will refer to that organization).

As a part of the registration or account creation process, You will create or receive personally identifying login credentials. Certain personally identifying information, such as email address, phone number, billing address and even payment information (as may be applicable to particular Services which may be offered for sale via this Website), may also be required such as registration must be accurate and current.

The benefits, rights and obligations afforded under these Terms are personal to You. You agree not to assign, sublicense, transfer, pledge, sell, lease, rent, lend, or otherwise dispose of the Services and materials (including, but not limited to, audio and/or visual presentations, documentation, software, printed or digital materials, and other elements characterizing Our Services, also known as the "Content") on this Website, or any part of such Content, or share your rights under these Terms to and with others. 

You agree that You will not provide false information to Us in generating Your account. Specifically, You agree that you will not:  select or use the login credentials of another person or company with the intent to impersonate that person or company, or use login credentials in which another person or company has rights without such person´s or company´s authorization. 

Failure to comply with the forgoing shall constitute a breach of these Terms, which may result in immediate suspension or termination of your account. Only authorized users, who have fully attained access to the Content by personally agreeing to these Terms are permitted participation in and use of the Services, Content, and related materials. Except as expressly authorized by these Terms, You shall not provide or make available any Content or any license key to any third party, or use the Content, or any license key, to teach any third party any portion of the Services or for any purpose other than exercising rights expressly granted to you by these Terms.

You are responsible for maintaining the confidentiality of Your login credentials. We reserve the right to terminate or suspend Your access to the Services if You share Your credentials or transfer such credentials to another party. 

  • 3.1 In order to procure Services on this Website and to use certain other parts of the System, you are required to create an Account which will contain certain personal details and Payment Information which may vary based upon your use of the Website as We may not require payment information until you wish to make a purchase. By continuing to use this Website you represent and warrant that:
  • 3.1.1 all information you submit is accurate and truthful;
  • 3.1.2 you have permission to submit Payment Information where permission may be required; and
  • 3.1.3 you will keep this information accurate and up-to-date. Your creation of an Account is further affirmation of your representation and warranty.
  • 3.2 Do not share your Account details, particularly your username and password. We accept no liability for any losses or damages incurred as a result of your Account details being shared by you. If you use a shared computer, it is recommended that you do not save your Account details in your internet browser.
  • 3.3 If you have reason to believe that your Account details have been obtained by another person without consent, you should contact Us immediately to suspend your Account and cancel any unauthorised orders or payments that may be pending. Please be aware that orders or payments can only be cancelled up until provision of Services has commenced. In the event that an unauthorised provision commences prior to your notifying Us of the unauthorised nature of the order or payment then you shall be charged for the period from the commencement of the provision of services until the date you notified us and may be charged for a billing cycle of one month.
  • 3.4 When choosing your username you are required to adhere to the terms set out above in Clause 9. Any failure to do so could result in the suspension and/or deletion of your Account.

4. No Refunds

Unless otherwise stated in writing with respect to particular Services offered for sale via this Website or any representative of Foundations For Success, Foundations for Success abides by a strict, no refund policy. By accepting these Terms, You agree and understand that you are foregoing the right to claim any refund of fees paid for access and use of the Services offered via this Website or any representative of Foundations For Success.

5. No Warranties

By accepting these Terms, You agree and understand that FFS provides seminars and business coaching services only and guarantee no specific results. You acknowledge that We make no promise or representation that You will make a certain amount of income, profit or any amount of money, or any money, or that you will lose money, as a result of using these Services.

Any earnings, revenue, income or profit statements viewable on this Website, Our related Social Media or any representative of Foundations For Success Inc. are based on actual individual results of our clients and/or estimates as may be stated. There are no guarantees that you will make these levels for yourself. As with any business, Your results will vary and will be based on your personal abilities, efforts, experience, knowledge, capabilities, level of desire, and an infinite number of variables beyond Our control, including some variables that neither We nor You may have anticipated. There are no guarantees concerning the level of success You my experience. Each person’s results will vary.

There are unknown risks in any business, particularly with Real Estate and with Internet where markets, advances, changes and more can happen quickly. The use of Our Information, Products and Services should be based on Your own due diligence and You Agree That We Are Not Liable For Your Success Or Failure.

In accepting these Terms, You acknowledge that You take full responsibility for Your own success.

In no event will We be liable to You or any party related to You for any damage, including damages for loss of business profits or other pecuniary loss, whether under a theory of contract, warranty, tort (including negligence), products liability or otherwise, even if We have been advised of the possibility of such damages.   • 9.4 You acknowledge that any information you send to Us through Our System may be modified by Us in any way and you hereby waive your moral right to be identified as the author of such information. Any restrictions you may wish to place upon Our use of such information must be communicated to Us in advance and We reserve the right to reject such terms and associated information.

10. Termination and Cancellation of Accounts

We may elect to terminate the Services on this Website at Our discretion without notice to You or any liability for any reason whatsoever, including without limitation if You breach these Terms. You may terminate any account You establish via this Website at any time upon written notice to Us.
  • 10.1 Either Foundations For Success or you may terminate your Account. If We terminate your Account, you will be notified by email and an explanation for the termination will be provided. Notwithstanding the foregoing, We reserve the right to terminate without giving reasons.
  • 10.2 If We terminate your Account, any current or pending orders or payments on your Account will be cancelled and provision of Services will not commence.

11. Cancellation of Orders and Services

We want you to be completely satisfied with the products or services you order from Foundations For Success. If you need to discuss your order, please contact our customer care team by email at (support@foundationsforsuccess.com).

You may cancel an order that we have accepted; however, no refunds will be issued.

Our services deliver immediate value through instant access to course materials and knowledge on our platform. By placing an order, you acknowledge, agree, and understand that:

- Cancellation does not entitle you to a refund.
- Cancellation means termination of access to course materials and closure of your account—it is not a refund.

Exceptions (At Our Sole Discretion)
Cancellation with a partial refund may be granted only in the following limited cases:

1. A technical issue or error on our part that prevents you from accessing the course.

2. Applicable ONLY to LIVE COACHING courses: Before any LIVE courses begin, if the Foundations For Success (FFS) team determines you are not a good fit for the program, we may, at our sole discretion, issue a partial refund.
 
All decisions regarding exceptions are final.

12. Services, Pricing and Availability

  • 12.1 Whilst every effort has been made to ensure that all general descriptions of Services available from Foundations For Success correspond to the actual Services that will be provided to you, We are not responsible for any variations from these descriptions as the exact nature of the Services may vary depending on your individual requirements and circumstances. This does not exclude Our liability for mistakes due to negligence on Our part and refers only to variations of the correct Services, not different Services altogether. 
  • 12.2 Where appropriate, you may be required to select the required Plan of Services.
  • 12.3 We neither represent nor warrant that such Services will be available at all times and cannot necessarily confirm availability until confirming your Order. Availability indications are not provided on the Website.
  • 12.4 All pricing information on the Website is correct at the time of going online. We reserve the right to change prices and alter or remove any special offers from time to time and as necessary.
  • 12.5 In the event that prices are changed during the period between an order being placed for Services and Us processing that order and taking payment, then the price that was valid at the time of the order shall be used.

13. Orders and Provision of Services

  • 13.1 No part of this Website constitutes a contractual offer capable of acceptance. Your order constitutes a contractual offer that We may, at Our sole discretion, accept. Our acceptance is indicated by Us verifying full payment has been received by FFS AND when We have sent you an order confirmation email (this may happen at different times), will there be a binding contract between Foundations For Success and you.
  • 13.2 Order confirmations under sub-Clause 13.1 will be sent to once payment has been made Services begin and shall contain the following information:
  • 13.2.1 Confirmation of the Services ordered including full details of the main characteristics of those Services;
  • 13.2.2 Fully itemized pricing for the Services ordered including, where appropriate, taxes, delivery and other additional charges;
  • 13.2.3 Relevant times and dates for the provision of the Services;
  • 13.3 If We, for any reason, do not accept your order, no payment shall be taken under normal circumstances. In any event, any sums paid by you in relation to that order will be refunded within 14 calendar days.
  • 13.4 Payment for the Services shall be taken via your chosen payment method, immediately for any setup fee that corresponds to the service plan you purchased and at the same day of each subsequent month (“billing cycle”) for charges accrued during the previous month (“billing cycle”) AND/OR as indicated in the order confirmation you received.
  • 13.5 We aim to fulfill your DIY Orders within 2-3 working days, and for LIVE Events start dates will be on the applicable start date or if not, within a reasonable period following your Order, unless there are exceptional circumstances. If we cannot fulfill your Order within a reasonable period, we will inform you at the time you place the Order by a note on the relevant web page or by contacting you directly after you place your Order. Time is not of the essence of the Contract, which means we will aim to fulfill your Order within any agreed timescales but this is not an essential term of the Contract and we will not be liable to you if we do not do so. If the Services are to begin within 14 calendar days of Our acceptance of your order, at your express request, you will be required to expressly acknowledge that your statutory cancellation rights, detailed above in Clause 11, will be affected. By reading, agreeing and accepting these terms, you waive all entitlement for a refund.  
  • 13.6 Foundations For Success shall use all Our reasonable endeavours to provide the Services with reasonable skill and care, commensurate with best trade practice.
  • 13.7 In the event that Services are provided that are not in conformity with your order and thus incorrect, you should contact Us immediately to inform Us of the mistake. We will ensure that any necessary corrections are made within five (5) working days, however by reading, agreeing and accepting these terms, you agree that No Refunds are given because of the nature of the Services.
  • Additional terms and conditions may apply to the provision of certain Services. You will be asked to read and confirm your acceptance of any such terms and conditions when completing your Order.
  • 13.8 Foundations For Success provides technical support via emailing support@foundationsforsucess.com. Foundations For Success makes every effort possible to respond in a timely manner but we do not guarantee a particular response time.

Foundations For Success uses industry best practices to provide a high uptime, including a fault-tolerant architecture hosted in cloud servers. We give no warranty that the Website or Facilities will be free of defects and / or faults and we do not provide any kind of refund for outages. We provide no warranties (express or implied) of fitness for a particular purpose, accuracy of information, compatibility and satisfactory quality.
  • 19.2 We accept no liability for any disruption or non-availability of the Website resulting from external causes including, but not limited to, ISP equipment failure, host equipment failure, communications network failure, power failure, natural events, acts of war or legal restrictions and censorship.

20. Limitation of Liability

  • 20.1 To the maximum extent permitted by law, We accept no liability for any direct or indirect loss or damage, foreseeable or otherwise, including any indirect, consequential, special or exemplary damages arising from the use of the Website or any information contained therein. You should be aware that you use the Website and its Content at your own risk.
  • 20.2 Nothing in these Terms and Conditions excludes or restricts Foundations For Success liability for death or personal injury resulting from any negligence or fraud on the part of Foundations For Success.
  • 20.3 Nothing in these Terms and Conditions excludes or restricts Foundations For Success's liability for any direct or indirect loss or damage arising out of the incorrect provision of Services or out of reliance on incorrect information included on the Website.
  • 20.4 In the event that any of these terms are found to be unlawful, invalid or otherwise unenforceable, that term is to be deemed severed from these Terms and Conditions and shall not affect the validity and enforceability of the remaining Terms and Conditions. This term shall apply only within jurisdictions where a particular term is illegal.

In the event that any party to these Terms and Conditions fails to exercise any right or remedy contained herein, this shall not be construed as a waiver of that right or remedy.

In the event of any conflict between these Terms and Conditions and any prior versions thereof, the provisions of these Terms and Conditions shall prevail unless it is expressly stated otherwise.

23. Third Party Rights

Nothing in these Terms and Conditions shall confer any rights upon any third party. The agreement created by these Terms and Conditions is between you and Foundations For Success.

24. Miscellaneous

These Terms may not be modified or amended orally, implied, or in any manner not set forth in duly executed writing or otherwise permitted by these Terms.

We reserve the right to modify, terminate, or otherwise amend Services available via this Website and related Social Media accounts. We my, in the future, offer new and/or different Services and/or features through its Website and associated Social Media accounts. Such new features and/or Services shall be subject to these Terms.

Our failure to enforce any rights granted by these Terms or to take action against any party in the event of any breach shall not be deemed a waiver by Us as to subsequent enforcement of rights or subsequent actions in the event of future breaches.

These Terms in all respects shall be governed by and construed according to the laws of Alberta Canada. The venue for any dispute shall be in the City of Edmonton.

This Agreement is entered into in Edmonton, Alberta. You agree and consent to exclusive jurisdiction and venue of the province of Alberta and city of Edmonton for any dispute arising from or related to this Agreement.
 
Should any part of these Terms be declared void or unenforceable, that term shall be severed from these Terms and such declaration shall have no effect on the enforcement of the remaining Terms.
